Financial Durable Power of Attorney
This legal document is as integral as any within your estate planning portfolio. By executing a financial durable power of attorney you are authorizing another to act for you in the event of your incapacity in all financial matters large and small, from writing checks to pay your bills to engaging legal action on your behalf. Failure to sign a properly prepared durable power of attorney will force a court that has little or no knowledge of your situation or your wishes to appoint a guardian (or "Curator") for you if you can't handle your affairs for yourself for as long as your incapacity continues.
